Apple Valley-Sunland Center Re-zoning

Before the overlay was approved in 2006, 4.0 Construction managed to rezone the property on Apple Valley between Parkside and Sunland to PC-2, and it was added to the overlay. The oversized project never materialized, and the owners were left with overlay restrictions and a practically unusable zoning.

Nonami Oglethorpe, LLC, representing Cousins Foundation, devised a plan to rezone the Parkside half to C-1 to build a three-story, mixed use commercial building to house the Foundations’ offices, and because they had no intention of building residential at the other end, rezoned the Sunland residential properties to RM-75 so the owners’ active homes conformed.

The newest development to be approved for the overlay easily fit within mixed use requirements and Nonami agreed to carry over original conditions agreed to by Sunland neighbors. BPCA and all neighbors involved consider Cousins Foundation headquarters to be an excellent addition to the community, and there was no opposition to the rezoning.
